You've fallen in love and now need a visa to stay together in Australia.  Whether your's is a new relationship, or you've been together for years and maybe even have children, there is a visa for your circumstances.  iVisas takes to time to get to know your story, and works with you to best communicate that to the officer at the Department of Immigration who will decide on your application.  We assist in helping you to understand the evidenciary requirements, advise on how to collect the documentation and prepare your personal statements.

The types of visas you can apply for will depend on whether you are already married or have a registered civil union, or have lived together for a certain period of time.  In most circumstances you (or your partner) will be granted a 'provisional' (temporary) visa first, and then after a period 2 years will submit more documentation to confirm you are still in a relationship in order to obtain a permanent visa.  The exception to this is if your relationship is defined as 'long term' or you have children together and a shorter relationship in which case you may be able to apply straight away for a permanent visa.  The visa you will apply for will also be determined by whether you will be inside or outside Australia when you apply.

If you have not lived together but are engaged, then you can apply for a Prospective Spouse (Fiance/e) visa.  This will allow you come to Australia, and give you 9 months in which to marry and lodge a partner visa application based on the marriage.

Australia recognises same sex relationships, and valid Australian or overseas marriages or unions for the purposes of its partner visas.  Currently, same sex marriages are not legally able to be performed in Australia, although civil unions exist for residents of certain States and Territories in Australia.  If you are in a same sex relationship and need a visa, talk to us about assessing which visa subclass and pathway is the best for you to follow as a couple.

- 309 Partner (Provisional) visa (offshore)

- 820 Partner (Provisional) visa (onshore)

Permanent Visas

- 100 Partner (Permanent) visa (offshore)

- 801 Partner (Permanent) visa (onshore)
