Sponsorships

iVisas works with sponsors to ensure they understand the obligations, implement any changes to systems to ensure compliance, and decide whether the sponsorship is the right decision for their business requirements and operational needs. We work with you to help to reduce the administrative burden of being an 'Approved Sponsor'. 

When a business wants to employ an overseas worker, and that worker does not have work permission on their current visa, then they need to become an 'Approved Sponsor' in order to nominate that person for another appropriate temporary visa with work rights in order to employ them lawfully.

Temporary work visas include:

  • 457 Temporary Work (Skilled) visa
  • 401 Temporary Work (Long Stay activity) visa
  • 402 Training & Research visa
  • 420 Temporary Work (Entertainment)
Each of these visas have different sponsorship approval processes currently, and cover different types of work activity.

The most common visa used by employers is the 457 Visa.

Standard Business Sponsor (457 visa program)

Both Australian and Overseas businesses wishing to employ workers in Australia, or send current overseas employees to work in Australia, can utilise the 457 visa program and become Standard Business Sponsors.  The requirements for each type of business however are slightly different.

If the business does not operate in Australia, you must be able to show that you need a skilled worker to:

  • come to Australia to establish, or help establish, a business operation with connections with a business located outside Australia
  • fulfil, or help in fulfil, a contractual obligation.
All businesses must demonstrate they are actively operating, lawfully compliant with the region in which they operate and cannot be involved in any unacceptable business practises.

Australian businesses must demonstrate a commitment to training Australians and meet training expenditure benchmarks.

All 'Approved Sponsors' must meet Sponsorship Obligations, which are set through legislation and change regularly to match employment conditions and requirements in Australia.  Employers must ensure they keep records of all required documents according to those obligations for a specified period of time, and notify the Department of Immigration and Border Protection of certain events within specifed time periods, and comply with any requests by Inspectors.

Breaches of the obligations and sponsorship commitments are serious and can result in sizeable on-the-spot fines per breach and risk further fines and even prosecution and jail terms.
